Job Description
A: Costing Establish, Update, and ensure adherence to contracts management procedures. • Review and analyse tender documents from commercial and contractual. point of view (Salient conditions, list of clarifications, exceptions and deviations, risk identification and assessment) • Prepare risk register & mitigation plan from contractual point of view • Analyse reasons for delays and disruptions, identify client related reasons and issue notification and change orders to the client in consultation with the Project Manager • Draft, negotiate and finalize MOU, NDA, etc, • Draft and negotiate terms for Subcontracting jobs. • Organize Bank Guarantees for the awarded Projects • Support the BD team by resolving the queries raised by Client on the technical proposal. • Resource Estimation : Estimate the required tentative Human resource services, materials, tools, tackles, etc. for O&M contract. • Identify & validate the required Spares, consumables, Services, etc B: Commercial T&C’s in Sales phase • Techno-commercial evaluation of Quotations. • Techno-commercial negotiations with Subcontractors & Service Providers. • Support Project Manager in all contractual discussions with the client • Provide assistance to Business Development team for drafting clarifications and deviations to Tender. • Review Risk Register in line with LT-EH terms & conditions based on Probability & severity of Risk. • Develop understanding of internal working of owner / client’s project management and other departments (like Legal, Finance, Operations) to ensure effective discussion/ resolution of contractual claims • Identify insurance requirements for the project, monitor renewal and closure of insurance policies • Provide inputs on local tax laws, INCOTERMS, FIDIC provisions etc. to the Project Manager • Obtain review from Legal function • Participate in pre-bid meetings and negotiations with client, seek commercial clarifications • Support Delivery team on contract administration throughout the project lifecycle (change orders, scope extensions) • Provide inputs to Delivery Manager to prioritize change orders and build basis for negotiation with the client • Monitor Commercial performance of Projects C: Contract Management during Execution phase Support Delivery team on contract administration throughout the project lifecycle (change orders, scope extensions) • Provide inputs to Delivery Manager to prioritize change orders and build basis for negotiation with the client • Provide inputs to enable procurement and construction, formulate ‘back to back’ T&C for inclusion in agreements with subcontractors / vendors • Monitor Commercial performance of Projects D: Procurement of Services • Preparing MIS report on progress status of procurement. • Proposals : Reviews the scope of work and seeks clarifications for ambiguous / Incomplete / incorrect information Purchase Order generation and vendor follow-up for vendor documents. • Internal follow-up for vendor document approval. • Logistics arrangement for delivery of material to the Site and Coordination with transporter. • Monitoring of delivery schedule till final delivery of material to the end user. • Work closely with Delivery Team to ensure proper and timely delivery of supplies including follow-up with suppliers for on-time delivery. |
